职业篮球运动员聘用合同的法律性质与法律适用研究——以CBA国内球员聘用合同为例

Legal Nature and Application of Professional Basketball Players’ Employment Contracts:An Example of CBA’s “Domestic Player Employment Contract”

摘要:

CBA公司标准版《国内球员聘用合同》在明确俱乐部与球员权利义务关系、规范俱乐部间有序竞争等方面发挥了重要的积极作用,但同时也面临着法律性质与法律适用不清晰等问题,引发了实践中的诸多纠纷。综合运用判例研究法、国际比较研究法、规范分析法等研究方法,从劳动关系的判定标准、劳动合同的内容条款以及不同情形下球员与第三方机构的关系等三方面对聘用合同的性质进行了讨论,主张职业篮球俱乐部与球员之间属于劳动关系而非劳务关系,其间的聘用合同属于劳动合同而非劳务合同,聘用合同的规范应当适用劳动法而非民法体系。从独家签约权条款、工资帽制度以及合同买断等方面,对聘用合同在适用《中华人民共和国劳动合同法》等劳动法律法规过程中存在的问题进行了考察,并提出了针对性建议,以促进提升聘用合同的规范化水平以及职业篮球运动的健康可持续发展。

Abstract:

CBA’s Domestic Player Employment Contract has been playing a positive role in clarifying the clubs’ and players’ rights and obligations, and in regulating the competition between clubs. However, there are also many problems such unclear legal nature and legal application, causing many disputes in practice. Through international comparative analysis, legal case study, and normative analysis, the paper discusses the legal nature of the contract from three aspects: the judgment standard of labor relationship, the content of labor contract, and the relationship between players and third-party institutions. It suggests that the employment relationship between clubs and players is labor relations rather than labor service relationships, and their contracts are labor contracts rather than labor service contracts. Therefore, the contracts should be regulated using labor law rather than civil law. Furthermore, the paper examines the problems when applying labor law to the contract by analyzing the exclusive signing right clause, salary cap system and the contract buyout. It puts forward suggestions on regulating the contract to promote the healthy and sustainable development of professional basketball.
